These Terms of Service ("Terms") govern your use of the Tate Jacob website and your purchase of any products from us. Please read them carefully. By using our website or placing an order, you agree to these Terms. If you do not agree with them, please do not use our website or place an order.

1. Who we are

This website is operated by Tate Jacob, a trading name of Blake Hampton Ltd, a company registered in England and Wales under company number 16570675, with its registered office at 35 Bowood Avenue, Eastbourne, BN22 8SN, United Kingdom. Our US office is located at 300 Kent Avenue, Suite 402, Brooklyn, NY 11249.

Throughout these Terms, "Tate Jacob", "we", "us" and "our" refer to Blake Hampton Ltd trading as Tate Jacob. "You" and "your" refer to the person using our website or placing an order.

You can reach us any time at support@tatejacob.com. Our support hours are Monday to Friday, 9:00 AM to 5:00 PM EST.

2. Definitions

A few terms used throughout, for clarity:

  • Website means tatejacob.com and any of its pages.
  • Products means the goods we offer for sale on the Website.
  • Order means a request you submit to buy Products from us.
  • Contract means the agreement between you and us for the sale of Products, formed as described in Section 5.
  • Terms means this document.

3. Eligibility

To place an order with us, you must be at least 18 years old and able to enter into a legally binding contract. By placing an order, you confirm that you meet these requirements. If you are under 18, you may use the Website only with the involvement of a parent or guardian.

4. Your account

You can shop with us as a guest, or you may choose to create an account. If you create an account, you are responsible for keeping your login details private and for any activity that happens under your account. Please let us know at support@tatejacob.com if you believe your account has been used without your permission. We may suspend or close an account if we reasonably believe it has been misused.

5. Orders and how a contract is formed

When you place an order, you are making an offer to buy the Products in your basket. We will send you an order confirmation email acknowledging that we have received your order. This acknowledgement does not mean your order has been accepted.

A contract between us is only formed when we send you a dispatch confirmation email telling you that your Products have been sent. If we are unable to accept your order — for example, because a Product is out of stock, because of an error in the price or description, or because we are unable to obtain payment — we will let you know and will not charge you, or will refund any payment already taken.

We reserve the right to refuse or cancel any order at our discretion, including where we suspect fraudulent activity.

6. Products and availability

We take care to describe and show our Products as accurately as we can. Even so, slight variations in colour, texture and finish can occur, partly because screens display colour differently and partly because our Products are made from natural materials. These small differences are normal and are not faults.

All Products are subject to availability. We may change or discontinue any Product at any time.

7. Pricing

Prices are shown on the Website in US dollars (USD) and include any applicable taxes unless stated otherwise. Delivery charges are shown separately at checkout before you confirm your order.

We try to ensure all prices are correct, but errors can occasionally occur. If we discover an error in the price of Products you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel the order. If we cannot reach you, we will treat the order as cancelled and refund any payment in full.

8. Payment

Payment is taken at the time you place your order, through the payment methods offered at checkout. By submitting an order, you confirm that the payment details you provide are your own and that you have sufficient funds to complete the purchase. All payments are processed securely by our third-party payment providers; we do not store your full card details.

9. Promotional codes and discounts

From time to time we may offer promotional codes or discounts. Unless stated otherwise, these cannot be combined with other offers, apply only while the offer is live, may be withdrawn at any time, and have no cash value. We reserve the right to cancel an order where we reasonably believe a code has been used in a way it was not intended.

10. Shipping and delivery

We ship worldwide. Delivery timeframes, costs and the details of how we handle dispatch are set out in our Shipping Policy, which forms part of these Terms. Any delivery dates we give are estimates and are not guaranteed.

11. Risk and ownership

Responsibility for the Products passes to you when they are delivered to the address you gave us. Ownership of the Products passes to you once we have received payment in full.

12. Returns, refunds and cancellations

Our Returns & Refunds Policy sets out how to return an item and when you are entitled to a refund, and forms part of these Terms. In short, we accept returns within 30 days, and approved refunds are issued to your original payment method within 5–10 business days of us receiving and inspecting the returned item.

Nothing in these Terms affects your statutory rights as a consumer, including any right you may have to cancel an order or to a remedy where Products are faulty, not as described, or not fit for purpose.

13. Acceptable use of the Website

You may use our Website for lawful, personal purposes only. You agree not to:

  • use the Website in any way that breaks the law or infringes anyone's rights;
  • attempt to gain unauthorised access to the Website, its servers, or any connected system;
  • introduce viruses or any other harmful material;
  • copy, scrape, resell or exploit any part of the Website or its content without our written permission; or
  • use the Website in a way that could damage, disable or impair it.

We may restrict or withdraw your access to the Website if you breach this section.

14. Intellectual property

All content on the Website — including text, images, graphics, logos, product photography, page design and the Tate Jacob name — belongs to us or our licensors and is protected by intellectual property laws. You may view and use the Website for your own personal, non-commercial use. You may not copy, reproduce, distribute or use any of our content for commercial purposes without our prior written consent.

15. Content you submit

If you submit content to us — for example, a product review or a photograph — you keep ownership of it, but you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce that content in connection with our business. You are responsible for anything you submit and confirm that it is your own, is accurate, and does not break any law or infringe anyone's rights. We may remove any submitted content at our discretion.

16. Third-party links

Our Website may contain links to other websites — for example, an order-tracking service. We provide these links for convenience only. We do not control those websites and are not responsible for their content, their products, or their handling of your information. Visiting them is at your own risk, and their own terms and privacy policies will apply.

How we collect and use your personal information is explained in our Privacy Policy, which forms part of these Terms. Please read it to understand how we handle your data.

18. Availability of the Website

We work to keep the Website available and running smoothly, but we cannot guarantee it will always be uninterrupted or error-free. We may suspend, withdraw or restrict all or part of the Website for business or operational reasons, and will try to give reasonable notice where we can.

19. Our responsibility to you

We take our Products and our service seriously, and nothing in these Terms limits our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under English law.

Subject to that, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care, but we are not responsible for any loss or damage that is not foreseeable, or for any loss that arises from your own misuse of our Products or the Website. Because our Products are supplied for personal, domestic use, we are not liable for any business losses.

20. Events outside our control

We are not responsible for any failure or delay in meeting our obligations to you where that failure or delay is caused by events outside our reasonable control — for example, extreme weather, strikes, failures of transport or communications networks, acts of government, or other events of a similar nature. If such an event occurs, we will let you know and will take reasonable steps to limit any delay.

21. Termination

We may end or suspend your access to the Website and cancel any contract with you if you seriously or repeatedly breach these Terms. Ending the contract will not affect any rights or obligations that have already arisen.

22. Changes to these Terms

We may update these Terms from time to time — for example, to reflect changes in how we operate or in the law. The version published on the Website is the one that applies to your use of it. Any order you place is governed by the Terms in effect at the time you place it. We recommend checking this page from time to time so you are aware of any changes.

23. General

If any part of these Terms is found to be unenforceable, the rest of them will continue to apply. If we do not enforce a right under these Terms straight away, that does not mean we give up that right. You may not transfer your rights under these Terms to anyone else without our agreement. These Terms are the entire agreement between us regarding your use of the Website and your purchase of Products.

24. Governing law and jurisdiction

These Terms, and any dispute arising from them or from your use of the Website, are governed by the laws of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere, you may also be entitled to bring proceedings in your own country, and nothing here removes protections available to you under the law of your country of residence.
